FREE MARKETS AMENDMENT

ARTICLE 28 (or alternate number to be assigned by Congress)

Section 1.  It is the right of citizens to enjoy the pursuit of happiness in an economy that is governed by free market principles.  This is foundational to a free people and must not be violated by the State. 

Section 2.  To secure the rights of citizens it is prohibited for any branch or agency of government, to prevent the free exercise of free market principles in the nations economy.   It is further prohibited for the government to impose on individuals or companies unreasonable regulations that prohibit the free exercise of an open market economy.  These prohibitions do not prevent the government from restricting, regulating or stopping unfair trade practices of foreign governments, foreign companies or foreign individuals.   The government can also restrict or prevent ownership in American companies or American assets by foreign governments, foreign companies or foreign individuals.  The provisions of this Article are enforceable within the United States which shall include the Several States, the District of Columbia, and the Commonwealth of Puerto Rico, the Commonwealth of the Northern Mariana Islands and the territories and possessions of the United States.

Section 3. Congress shall have the power to enforce by appropriate legislation, the provisions of the Article.
